Evorios is a neighborhood platform that connects neighbors who want to rent, buy, or give items to one another. Evorios is not a party to those transactions — neighbors deal directly with each other, and Evorios provides the tools and records that make it work.
These Terms of Service ("Terms") are a binding agreement between you and Evorios LLC, a Wyoming limited liability company ("Evorios," "we," "us," or "our"). They govern your use of evorios.com, the Evorios progressive web app at app.evorios.com, and all related services (together, the "Platform"). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
Evorios operates a neighborhood marketplace where each household can open a "garage" and offer items to neighbors nearby. The Platform is neutral infrastructure: we provide listing tools, discovery, messaging, payment processing through third parties, and a record of handoffs.
We are not a party to transactions between users. Evorios does not own, sell, rent, inspect, store, or take possession of any item listed on the Platform. When a neighbor rents, buys, or receives an item, the agreement is solely between the two users. We do not guarantee the quality, safety, legality, or availability of any item, or the conduct of any user.
You must be at least 18 years old and able to form a binding contract to use the Platform. The Platform is intended for use in the United States. By using it, you represent that you meet these requirements and that the information you provide is accurate.
Sign-in codes & messages. We send sign-in verification codes to your email. If you add and verify a phone number, we may send transaction SMS — booking confirmations, rental reminders, and return notifications — through our delivery provider, Twilio; we do not send marketing texts. Message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. Your mobile number and SMS consent are never shared with third parties or affiliates for marketing or promotional purposes. If you install Evorios and allow notifications, we may also send push notifications for transaction updates, which you can turn off in your device settings.
If you list an item, you represent that you own it or have the right to offer it, and that your listing is accurate and not misleading. You set the price and the mode (Rent, Buy, or Gift). You are responsible for the condition, safety, and legality of your items, and for any licenses, permits, or taxes that apply to you.
You may not list items that are illegal, stolen, counterfeit, recalled, hazardous, or otherwise prohibited by law or by these Terms, including weapons, controlled substances, and items you do not have the right to transfer. We may remove any listing at our discretion.
The terms of each transaction (price, condition, pickup, return, and any conditions) are set between the users. Evorios provides the framework but is not responsible for whether users honor their agreements.
Payments are processed by our third-party payment provider (Stripe). Evorios does not store full card or bank details. By transacting, you agree to the payment provider's terms.
Listing is free. Evorios may charge a service fee or commission on paid transactions, which will be disclosed before you complete the transaction. Hosts receive payouts through the payment provider, subject to its verification and payout schedule. You are responsible for any taxes arising from your transactions.
For certain rentals, the host may require a refundable security deposit. When a booking is confirmed, the payment provider places an authorization hold on the renter's card. This is a hold, not a charge — the funds are reserved, not captured.
Evorios is not an insurer and does not provide insurance. "Deposit protection" refers only to the authorization-hold mechanism described above. Any coverage beyond the deposit is not provided by Evorios.
Pickups and returns may be confirmed by scanning a QR code and entering a PIN. These scans create timestamped records that both users can see. Evorios provides these records as a neutral log of events; they do not constitute a guarantee or a legal judgment about any transaction.
After a transaction, users may leave honest reviews. You may not post reviews that are false, abusive, or manipulated, or offer incentives in exchange for reviews. We may remove content that violates these Terms.
Transactions are between users, so disputes are primarily between users to resolve. Evorios is neutral: we provide transaction records, QR/PIN timestamps, messages, and photos to both parties, and we may release or hold a deposit according to the app's process. We do not arbitrate disputes, take sides, or guarantee any outcome. Legal claims arising from a transaction are between the users involved.
The Platform, the Evorios name and logo, Mr. Evorios, and all related content are owned by Evorios and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You retain ownership of the photos and content you upload, and you grant Evorios a license to host, display, and use that content to operate and promote the Platform.
The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Evorios does not warrant that the Platform will be uninterrupted, secure, or error-free, or that any item or user meets your expectations. You use the Platform, and transact with other users, at your own risk.
To the fullest extent permitted by law, Evorios and its owners, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or items, arising from your use of the Platform or any transaction between users. To the fullest extent permitted by law, our total liability for any claim relating to the Platform will not exceed the greater of the fees you paid to Evorios in the three months before the claim, or one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Evorios from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your listings or transactions, your content, or your violation of these Terms or any law or third-party right.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute between you and Evorios that is not resolved informally will be settled by binding arbitration on an individual basis, and you and Evorios waive the right to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us. Where arbitration does not apply, the state and federal courts located in Wyoming will have exclusive jurisdiction.
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice. Your continued use of the Platform after changes take effect means you accept the updated Terms. The date at the top reflects the most recent update.
You may stop using the Platform and delete your account at any time. We may suspend or terminate your access if you violate these Terms or create risk for the community. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
